Privacy Policy

In compliance with the information obligation specified in Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (HEREINAFTER: “GDPR”), the Personal Data Controller informs that:

2. Obligation to provide personal data

In cases related to the conclusion of a contract for the provision of legal services and its proper performance, the provision of personal data is voluntary but necessary for the conclusion or proper performance of the contract. In such situations, failure to provide the requested personal data may constitute an obstacle to the conclusion or performance of the contract.

3. Source of personal data

If personal data was not obtained directly from you, it was provided by a client, potential client, contractor of the Law Firm or another person in connection with a specific matter or the performance of a contract.

4. Data recipients

Your personal data will be transferred to third parties providing specific services to the Firm or to entities supporting the Firm’s own services (including entities responsible for supporting IT and administrative infrastructure, other law firms, attorneys or legal advisors with whom we have established cooperation in the field of legal representation). However, in each case, these entities will be obligated to maintain the confidentiality of your personal data and to process it in accordance with personal data protection regulations and the relevant instructions of the Firm.

Your personal data may also be transferred to relevant authorities or entities performing statutory tasks under relevant provisions (e.g. tax authorities).

The recipients of your personal data may be courts, prosecutors’ offices, administrative bodies, state services and other bodies, the list of which is specified in detail in the content of the power of attorney granted.

Your personal data is processed by the Law Firm’s office.

5. Data retention periods

Your personal data will be processed for the period necessary to perform the contract or fulfill the obligations arising from applicable regulations (including the limitation period for tax liabilities or the periods specified in the relevant provisions governing the exercise of the profession of attorney and the provision of legal services).

In justified cases arising from the need to pursue or defend against claims, your personal data will be stored for the limitation period of the relevant claims.

6. Rights related to the processing of personal data

You have the right to access your data, the right to request its rectification, deletion or restriction of processing, as well as the right to transfer your data and the right to object to the processing of your personal data.

You also have the right to lodge a complaint with the supervisory authority responsible for personal data protection (the President of the Personal Data Protection Office) if you believe that the processing of your personal data violates the provisions of the GDPR.

7. Changes to the Privacy Policy

Any changes introduced by the Law Firm to the Privacy Policy in the future will be published on the website  www.michalkula.pl/polityka-prywatnosci .
